Meridian City Council to TAKE UP

ordinance banning SPICE

 

Meridian, ID – (October 7, 2010) – During its 6:00 pm meeting on Tuesday, October 12, members of the Meridian City Council will consider a proposed city ordinance that would ban the selling, purchasing, and use of Spice, K2 and other related products. If approved by the City Council at Tuesday night’s meeting, the ordinance would take effect on October 18, 2010.

 

According to Community Services Lieutenant John Overton of the Meridian Police Department, “There is an urgent need for not just education but aggressive enforcement on the sale and possession of Spice and like products due to the dangerous effects when it is smoked by both adults and juveniles. It is marketed as incense in a completely unregulated industry even though it is well known that customers are actively smoking the product which is nothing more than a synthetic version of the active ingredient THC in marijuana and in many cases much stronger than marijuana itself.”

 

Under the proposed ordinance, it would be unlawful for any person to use, possess, purchase, or attempt to purchase any illegal smoking product, as well as make it unlawful for any person to sell, offer, to sell, give away, deliver, or publicly display for sale any illegal smoking product in the City of Meridian.

 

According to the City Attorney Bill Nary, “The City is taking this action in addition to the rule imposed by the Pharmacy Board scheduled to be signed by the Governor on October 15 to ensure the enforceability of actions by our police officers related to these products.  Having our own local ordinance should make it clear that we prohibit this product in our community.  Once the Legislature creates a statute prohibiting these products, it is our intent to repeal our local ordinance so long as it prohibits the same conduct.”
